A student accused of raping a woman while she was asleep insisted it had been an "consensual" act between them during which she had been awake, a court has heard.

Nayan Trivedi was a student at the UEA when he allegedly raped and sexually assaulted the intoxicated woman who had been sleeping in his bed after having also taken ketamine.

The 24-year-old from Southend has gone on trial at Norwich Crown Court having denied rape and assault by penetration of the woman, who is in her 20s, but cannot be identified for legal reasons, on February 3 2019.

Giving evidence on Thursday (April 27) Trivedi told Isobel McCarroll, defending, what happened between them had been consensual.

He told the jury of six women and six men they had been in bed "conversing" before "she started to press up against me".

Trivedi said it had been an "intimate interaction" between the two of them.

Miss McCarroll asked Trivedi what made him think it was a "consensual sexual experience".

He said she had been "gyrating, moving her hips" and "insinuating sex acts on me" as well as rubbing against him and heavy breathing.

Miss McCarroll asked whether there was "anything at all" either before or after which indicated she had been asleep at the time.

Trivedi said: "No, not at all."

He was asked whether there was anything which indicated she was so intoxicated she did not know what was going on but replied: "no".

Trivedi was asked whether they had sex and said they had after which "we both just went to bed".

When asked whether there was a second period of sexual activity, he insisted "no, not at all".

Miss McCarroll asked whether "at any point" he believed she was not consenting?

Trivedi said: "No, not at all".

The barrister said: "Did you take advantage of her?"

He replied: "Not at all."
